A U.S. citizen has argued before Canada's Immigration and Refugee Board in Vancouver that he should be granted refugee status over fears that he will be killed in his home country by police because he is black.

Kyle Lydell Canty, 30, crossed into B.C.'s Lower Mainland in early September of 2015, telling border agents that he was here to visit and take photographs, but once in Vancouver decided he would apply to remain as a refugee.

"I'm in fear of my life because I'm black," he told IRB member Ron Yamauchi in a hearing on October 23rd in Vancouver. "This is a well-founded fear."

Canty argues that black people are "being exterminated at an alarming rate" in the U.S. and included examples such as the shooting of Michael Brown in Missouri and the death of Eric Garner in New York City at the hands of police.

Canty represented himself at the hearing, which he applied to have made public, and was commended by Yamauchi at its conclusion, who said Canty had put together a "well prepared case ... and argued it as well as it could be."

Wow, K, and Tim, I was a little surprised at this post although I am not surprised at the request. There is some validity to his claim. I have spoken to some black people here and they are saying sooner or later they might have to protect themselves against the police. These people are law abiding people who really hate violence. They are saying if a black person calls the police they are running a risk of been killed, no mater what they do.


This is a serious and dangerous development in the United States. Canada is being pulled into something that it really does not follow the US. American will begin to resent Canadians if they think the request is justified. If Canada rejects, they could be seen as if they are in agreement with the US treatment of black people.
This is not good, so many black churches are being fire bombed, no one is sure from what side of the divide the attacks are coming. To be quite honest, I myself am not so sure about Americas treatment of African Americas anymore.

Why surprised at the post? These sorts of requests are not new. Randy Quaid (yes, the actor) claimed refugee status in Canada as he feels Hollywood is trying to kill him.

The article goes on to state how this man does have a criminal record... I feel his claim is bogus, either to start stirring up trouble or to find a place to continue his mischief. I'm quite irked by it or anything done just to 'prove a point' as there are thousands of people in the world right now who truly do need the help, who truly are trying to escape from a horrible reality.

I am not sure where you are coming from K, here in the US every black man is a criminal. And they have been going through their plight for hundreds of years. I would suggest you try to picture yourself loosing your son to any system because you are white. I am a little confused you think that the black persons present life is not a reality for them. 
I am seen as a criminal because I live in a black area, not because I committed a crime. 
I do respect your point of view, but I also know that you are speaking from a place where you really have no experience.
I do not see why this man should leave America to continue making trouble in Canada.

This reminds me of the way the people of New Orleans were treated after Hurricane Katrina, it was awful how they were not helped more and the length of time it took to get them any help in the first place. When we are sitting in other countries looking in, we only obviously see what the media shows us and I do see there have been problems in the US for a long long time, and these are still ongoing. In our day and age there should not be these problems with race and creed. When I went to cities such as Chicago and New Orleans, I was quite shocked at the segregation that exists there. We don't have that in this country.

Yes I noticed his Rap record Ka. I crossed my mind too that he would never be able to immigrate there (or here) with that background. So he may be genuinely afraid or just trying to prove a point. Either way there is something very dubious about him.

Stargate, my point was on this specific case and how I feel he's doing it for some other reason than actually properly needing refugee status. I said nothing about how black people are treated in general in the US and frankly I'm quite resentful about having my words twisted in that manner.

I grew up with refugees as friends, I still have friends who are/were refugees from places all over the world, and I have no problem with giving asylum to those who really and truly need it. I do not recall any of their stories being made public in such a manner. This is why I feel there are ulterior motives behind this situation. I can only go with my gut instinct after reading the entire article.

Tim, there might be something dubious about him like any other person, however that does not mean he is a monster who is just waiting to make mischief, he might have legitimate fears the same ones I have. We can no longer ignore the truth. Most black people are now living in fear of loosing their child in America. I challenge anyone to just walk over that.
This is crazy that we are having to still be discussing over this stupid reality today. 


If a black man makes a claim that he feels racially persecuted, it must first be established that he has a criminal record, and I might add, it does not take much to achieve that reputation. I have no choice but to defend that he or she may be a criminal, but also a person.

Please Kaere, I am not at war with you, I do not want to twist anything you say, but I feel compelled to respond to your remarks when I know my truths.


I don't care about tittles, I care about people, criminal or not. People print what they want to print, I have no input in that, but I don't believe everything they say based on my experience.


I can assure you K, the people in Syria are fleeing for their lives, black people have been suffering for a long time they have reached a place where they will do anything to be released from this burden of racism, even to the point of applying for asylum in countries known to be friends of the oppressor.

I agree Ka in this instance. There is something really odd about his motives and, like you, I can only go on my instincts.

I appreciate where you're coming from Star and I understand your concerns. Especially in the South of the US. Racism is alive and well there.

There is something going on in the United States Tim, nobody knows who is doing what, and why. This man according to my gut, ( if any of it is true) is trying to get outside attention to what is going on here.
I do not think there is anything wrong with his motive, I think he has fears. If you knew what he was saying was not true, I would want to think differently, but it is true at this point in time. Its no longer between black or white, it must be based on truth for us to become aware.

I have accepted your point of view , I hope you can accept mine and we move on. 
I am sorry you think I am twisting your words, if I did it was not deliberate. I find it good when we can speak our minds and leave it at that.
